Digital Millennium Copyright Act Policy

EveryGrove LLC ("EveryGrove," "we," "us") respects the intellectual property of others and complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"). This Policy describes how to submit a notice of alleged copyright infringement and how we respond.

1. Notice of Alleged Infringement

If you believe that material on the Services infringes your copyright, please send a written notice to our designated agent (below) that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

  • A physical or electronic signature of the owner of the copyright or a person authorized to act on the owner's behalf
  • Identification of the copyrighted work claimed to have been infringed (or, for multiple works on a single site, a representative list)
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to allow us to locate the material (for example, a URL)
  • Information reasonably sufficient to allow us to contact you, including address, telephone number, and email address
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

Misrepresentations. Section 512(f) of the DMCA imposes liability for knowingly making material misrepresentations in a notice or counter-notice. Submit notices in good faith.

2. Counter-Notice

If you believe material that was removed or disabled was removed by mistake or misidentification, you may submit a counter-notice that includes:

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled and the location at which it appeared before removal
  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or for any judicial district in which EveryGrove may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent

4. Repeat Infringers

We will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
